These Terms and Conditions are important. They are designed to be read by you and to assist you in your decision on whether you will enter into a contract with Commission Hunters Pty Ltd for the provision of the service defined below as Commission Refunding.
By accessing the website www.commissionhunters.com.au and using Commission Hunters Pty Ltd for the provision of the Commission Refunding service you are by default agreeing to these Terms and Conditions and creating a legally binding contract between you and Commission Hunters Pty Ltd.

Commission Refunding is the sole service provided by Commission Hunters and involves the discovery and collection on your behalf of any commission that you may be paying indirectly for the provision of financial planning or insurance to either an insurance broker or financial planner.

Terms and Conditions – The key terms

Commission Hunters operates a No Advice Service. This means that Commission Hunters is not providing any advice to you on the value, adequacy, completeness, competitiveness, or financial viability of the products such as personal insurance, general insurane, superannuation or mortgages that we investigate to see if we can discover and collect on your behalf any commission that you may be paying indirectly to a third party.

We are Commission Hunters! We are Not Financial Planners or Insurance Brokers. So all information displayed at www.commissionhunters.com.au is of a general nature only and it is not to be taken as either advice or any form of endorsement or recommendation. The information does not take into account any individuals needs, financial goals & objectives or financial circumstances. If you have any concerns or do not fully understand these Terms and Conditions We recommend that you discuss these Terms and Conditions with your Financial Planner or Insurance Broker.

Commission Hunters operates a No Commission No Fee Service. This means that We will only charge You a fee if We are successful in the discovery and collection on your behalf of any commission that you are paying indirectly for the provision of financial planning or insurance to either an insurance broker or financial planner or paid for your loyalty to a financial or insurance product.

General

‘Our’, ‘Us’ and ‘We’ refers to Commission Hunters Pty Ltd (ACN 061 414 300). Commission Hunters is an independently owned commission refunding business and is not a financial planner or insurance broker.

‘You’ and ‘Your’ refer to users of www.commissionhunters.com.au and of the Commission Hunters Commission Refunding service and a resident of Australia.

Service’ and ‘Commission Refunding’ refers to the service performed by Commission Hunters, which allows you to nominate Commission Hunters as Your broker and or financial planner for products that you have already purchased for the purpose of collecting any ongoing commission, which is then refunded to You. We do not offer financial or insurance advice services. Our service works only for existing financial, superannuation, insurance and credit products.

You agree to the use of digital signatures combined with opt in SMS and email validation, as evidence of explicit and informed consent for the provision of the Commission Refunding service by Commission Hunters.

You agree to receive promotional emails from us from time to time and emails regarding products and services that are for sale from the Commission Hunters website. We may receive fees from advertising on Our website and within our emails.

You agree to the use of email or SMS for all communication, correspondance and notifications between You and Us. You must notify Us of any change to Your email address or mobile telephone number within ten business days. Any notice required to be given under this agreement will be validly given if it is sent to the last known email address.

You will be notified of all changes to these Terms and Conditions and continued use of www.commissionhunters.com.au and the Commission Refunding service will be considered acceptance of the changes.

The jurisdiction for the interpretation and governance of these Terms and Conditions is in the state of Victoria and If any one or more of the Terms and Conditions are held to be invalid by a Court of Law, the remaining Terms and Conditions will continue with full effect.

Fees

Our fixed annual fee is $50 per policy, product, fund or account for the service provided by Commission Hunters being the discovery and collection on your behalf of any commission. This policy, product, fund or account may be in Your individual name or in joint names.

The fixed annual fee for the provision of the commission refunding service will only be deducted from your Commission Hunters account on the the receipt of your first commission refund from your insurance or financial provider and every 12 months after that. If no commission refund for that policy is received then the fixed annual fee will not be deducted from your account.

The fixed annual fee will automatically increase to reflect any increase in the Consumer Price Index (all groups) for the Capital City Melbourne published by the Australian Bureau of Statistics in respect of the preceding year. Commission Hunters reserves the right to increase the fixed annual fee by more than CPI, with notice 1 month prior to the 12 month anniversary date.

Commission Refunds

Only commission received by us from your insurance or financial provider can be credited to your account. Going forward if for any reason some of Your commission is claimed back or returned to Your current insurance or financial provider Commission Hunters retains the right to subtract this amount from Your account.

All commission refunds received from Your insurance or financial providers will be deposited in to Your account within 1 week of receipt of the funds.
Once the balance of Your account is positive you can purchase any product available for sale on the Commission Hunters website.

If the balance of Your account exceeds $250 You are then entitled to a cash refund of Your account by EFT only. To request this cash refund You must login to Your Commission Hunters account and provide Your bank account details. It is Your responibility to provide these details correctly. The cash refund will then be paid within the next month on Commission Hunters next scheduled refund day, normally being the 5th business day of the month.
If, after the 12 month anniversary of the receipt of your first commission refund from your insurance or financial provider and every 12 months after that, your Commission Hunters account does not have a positive or credit balance, we will return your balance to zero.

If no commission refund has been credited to Your account in any 12 month period We will return Your balance to zero and You will not be eligible for a refund or to shop with the balance.

Refer a Friend Program

We will deposit into Your Commission Hunters account $50 for the referral of a friend who becomes a customer of Commission Hunters and once over $500 of commission is received for that friend by Commission Hunters.

Complaints

We are committed to providing a quality service and resolving all customer complaints. If you have a complaint please contact email us at [email protected] with your name, contact number and prefered time for Us to contact You and We will call to discuss and resolve the comlpaint or issue.

Shopping

The products shown online are only available to be purchased from commission refunds that Commission Hunters have received on your behalf and are shown as a credit in your Commission Hunters account. Any shortfall between the purchase price and the balance of your commission refund account can be paid for by credit card. We only accept Mastercard and Visa.

Delivery of the products is to the address linked to your Commission Hunters account only. Delivery is subject to the products availability and delivery time is up to 10 working days from the date your payment is received. Every effort is made to deliver your products within this time frame and we will notify you if any delivery issue does delay the expected delivery date. If your product has not arrived after the estimated delivery time we encourage you to visit the “Your Account” section on our website to view the delivery status of your products. If no-one is available to take delivery of your products, our carrier (Australia Post eParcel) will leave a card so you can pick-up your product from your local Post Office.

Commission Hunters always hunts for the most competitive prices, but does not guarantee that the prices are the lowest in the market. We reserve the right to change prices for products displayed at any time before you place an order. The price of products shown excludes shipping costs but includes GST. Shipping cost is a separate charge which is shown on the product page and is calculated upon post code entry.

Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees. For more information about your rights as a consumer, see the Australian Consumer Law website at http://www.consumerlaw.gov.au. If a Product has a minor defect, we will provide a repair or offer you a replacement or a refund. If a Product has a major defect, you are entitled to a full refund.
Once you have purchased your product Commission Hunters will deduct from your account the value of your order. If you change your mind about a product or make an incorrect choice and return the product to us within 30 days of delivery, we will credit your account for unopened products in a resaleable condition.

Commission Hunters employs Secure Sockets Layer (SSL) technology software for its transactions with our customers, Commission Hunters will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Privacy

Commission Hunters is committed to ensuring that the privacy of your personal information is protected, we only use the information to track down and collect commissions that may be paid on your behalf. This requires us to share your information with the product issuers of the products that you already own for the purpose of identifying you in their systems.

We do not sell rent or lend your personal details with any other person or organisation and maintain your records in Australia.

Liability

To the maximum extent permitted by law, Commission Hunters disclaim liability for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or not delivered products, lost assets, profits or income, or stolen data, however caused arising out of or in connection with the use of the Commission Hunters Website and the Commission Hunters commission refund service.

Commission Hunters disclaim liability for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost assets, profits or income sustained in connection with an existing insurance, financial, credit or superannuation product from which Commission Hunters is collecting ongoing commission from the product providers on your behalf, as part of Our Service to You.

Your Responsibilities

You must notify Us of any change to Your email address or mobile telephone number within ten business days. Any notice required to be given under this agreement will be validly given if it is sent to the last known email address.

You are responsible for entering Your bank account or credit card details accurately, so Commission Hunters can deposit Your refunds into these accounts. Commision Hunters accepts no responisibility for lost refunds if you have entered incorrect account information.

You are responsible for keeping your Commission Hunters account number and password safe and secure. Commission Hunters accepts no responsibility from unauthorised third party use of Your account and commission refunds.

If you are unsure about the about the legal impact or the financial consequences of completing a Broker Nomination form or switching brokers or planners Commission Hunters recommends that You contact your existing financial planner or insurance broker to verify if engaging with Commission Hunters will nullify any protection or right that you may have of recourse against your financial planner or insurance broker for loss.

You Acknowledge

You acknowledge and agree that the Commission Hunters Website provides a ‘no advice’ service. We do not make any recommendations or endorsements of financial or credit products or their suitability for You. All information contained on our Website is factual information or general advice only and does not take into account Your objectives, financial circumstances or needs. We recommend that you speak to your financial planner or insurance broker before proceeding with Commission Hunters service.

You acknowledge that Commission Hunters provides a services which does not require an Australian Financial Services Licence.

You acknowledge and agree that Commission Hunters does not endorse or guarantee the performance of any financial products or make an offer or recommendation with respect to any financial product.

You acknowledge and permit Commission Hunters to complete Broker Nomination forms on Your behalf and to notify your insurance, credit and superannuation providers of you request for all on-going commission to be paid to Commission Hunters.
